Bylaws of Diamond Rose Academie d'Armes (adopted 2-5-05 and revised/re-adopted 2-12-06) Article I - Identification Diamond Rose Academie d'Armes is an historical educational guild dedicated to promoting an appreciation of the techniques and principles of Western European Martial Arts through the study and practice and fighting systems from the 15th through the 17th centuries, with an emphasis on the sword and other offhand weapons of the time period. The term Diamond Rose, Diamond Rose Guild, Diamond Rose School of Fencing, Diamond Rose School, Diamond Rose Academie d'Armes School or Diamond Rose Academie shall be considered synonymous with "Diamond Rose Academie d'Armes." Article II - Governance The Guild shall have four elected officers whose duties are listed below. These officers shall constitute the Board of Directors. In addition there may be any number of non-elected positions which may be held by any member in good standing. A. Officers 1. Guildmaster a. The Guildmaster shall function as the chief executive officer of the guild b. The Guildmaster is responsible for the overall function of the guild and this shall include: I. Liaison with other guilds and educational groups. II. Interaction with guest instructors. III. Any other job not specifically assigned. c. The Guildmaster shall have a quarterly meeting of the officers. All members in good standing are invited to attend. 2. Deputy Guildmaster a. The deputy Guildmaster shall function as the vice president of the guild. b. The deputy Guildmaster shall function as Guildmaster in the event the Guildmaster is unavailable. c. The deputy Guildmaster is responsible for assisting the Guildmaster as requested. d. The deputy Guildmaster shall work to foster contacts with other groups as well as performance venues and events. 3. Secretary a. The secretary is responsible for guild record keeping which shall include: I. Meeting minutes II. Membership roster and III. Information on past venues and events b. The secretary is responsible for providing information to Faire Boards and other educational venues upon request. This information may include gate lists or contact information. c. The secretary shall prepare an annual report summarizing events of the prior year. d. The secretary shall prepare educational information for distribution to interested members of the public. e. The secretary shall maintain a master list of medical issues, food allergies and emergency contacts. A copy of this list shall be provided to the Site Coordinator prior to each event. 4. Treasurer a. The treasurer is responsible for guild bookkeeping b. The treasurer shall prepare a quarterly summary and an annual report for review c. The treasurer shall collect all dues and donations d. The treasurer shall pay bills as instructed by the Guildmaster. The treasurer may at his/her discretion, pay a cumulative total of $100.00 per year without specific approval of the Board. e. The treasurer shall maintain copies of all paid receipts. B. Non-elected Officers 1. Quartermaster a. The quartermaster shall be appointed by the Guildmaster for the Faire season. b. The quartermaster is responsible for maintaining a master list of all the guild equipment, including personal equipment routinely used by the guild. This list should include the usual storage location for such an item when not in use. c. The quartermaster shall advise the Guildmaster if equipment is in need of repair or replacement, and may be instructed to repair or replace items. d. The quartermaster shall present quarterly and annual reports of inventory and upcoming needs. e. The quartermaster shall be in charge of the med kit and shall advise the Guildmaster if equipment needs repair or replacing 2. Site Coordinator a. The site coordinator shall be appointed by the Guildmaster for each event. b. The site coordinator may be called upon to cast a deciding vote if the guild board is deadlocked. c. The site coordinator is responsible for overall coordination when the guild is at any faire site. The site coordinator shall obtain a copy of the quartermaster's inventory and the secretary's master emergency/accident list prior to arrival at any event site. d. The site coordinator will assess encampment space and determine the best use of such space. As such, the site coordinator will determine the placement of items in the encampment. If the site coordinator is not expecting to be one of the first people on site, he/she may delegate another member for initial camp set-up. e. The site coordinator shall be responsible for ensuring adequate water and other refreshments during an event. The site coordinator may delegate this task to the food coordinator or other guild member. 3. Master at Armes a. The master at armes shall be appointed by the Guildmaster for each event b. The master at armes shall maintain the perimeter of the sparring area at all times. The marshal may request the assistance of other guild members or qualified guests in this task of being the marshal(s) of the games. c. The master at armes or his/her assistant(s) shall ensure the safety of all participants and guests within the perimeter of the sparring/bouting areas. d. The master at armes or his/her assistant(s) shall to the best of his/her ability oversee the safety of all observers by maintaining the perimeter of both the sparring area and encampment. e. If the master at armes or his/her designee calls "Hold" or "Halt", all activity in the sparring/bouting area must stop immediately. (see Appendix A) f. The master at armes shall be responsible for filing an accident report to the guild within 24 hours of any injury requiring medical attention, or any incident he/she deems necessary to be reviewed by the board. 4. Marshal of the Games a. The marshal of the games is appointed by the master at armes and may be more than one guild member or qualified guest or guest instructor. b. The marshal or marshals shall ensure the safety of all participants. c. The marshal(s) shall inspect the protective gear worn by any person in the sparring/bouting area. d. The marshal(s) may refuse to allow participation if such protective gear is absent or is deemed inadequate. e. The marshal(s) shall not allow participation if any participant (member, guest or faire patron) appears impaired in any way under the influence of alcohol or other drugs. f. If the marshal or his/her designee calls "Hold" or "Halt", all activity in the sparring/bouting area must stop immediately. (see Appendix A) C. Elections 1. Annual Elections a. Elected officers shall serve a term of one year. b. Annual elections shall be held during the first meeting of the new year. c. Officers shall take office on the date of the election or as soon as possible. d. All members of the Academie or Household who have rank and are in good standing may run for office e. All members of the Academie or Household who have rank and are in good standing may cast a ballot f. A simple majority vote of the officers and guildmembers present at the annual meeting (and proxy votes) is required. If there is no candidate with a 50% +1 majority of votes, then the two candidates with the most votes will proceed to a runoff election. In the case of only two candidates then votes will be cast until there is a majority for one candidate. 2. Other votes a. Vacancy: if during the course of the year an elected officer steps down for any reason, receives a vote of no confidence, or is expelled under the grievance process, the guild shall vote to elect a successor. This vote shall be announced a minimum of seven days in advance and shall be held in conjunction with the next regularly scheduled meeting. The Guildmaster may appoint an interim officer. The newly elected officer shall take office immediately upon a count of the votes. b. Bylaws: these bylaws may be revised by 2/3 vote (and proxy votes) of the officers and guildmembers present at the meeting. Proposed bylaws changes shall be made available in writing to membership a minimum of 15 days in advance of any election. c. No confidence: in the event that any member feels that an elected officer is not performing to the standards of their office, they may request a review by the remaining members of the board. The remaining members of the board shall conduct a review in a timely manner. Based upon the review, if a majority of the board feels that the complaint has merit, they may call for a vote of no confidence from the members in good standing. Such a vote will be announced 15 days in advance and shall require a 2/3 majority of all eligible voting guildmembers to recall the officer. d. If a member still feels that there is a problem, that member may bring it to a quarterly meeting and present it to the membership at large. The guildmembers present at the time may vote to review the issue or deny the issue. If the issue is to be reviewed, there will be a vote of no confidence as described in section c. Article III - Membership A. Members 1. Membership will be offered to a person who has a. Expressed an interest in learning about and teaching other about European Marshal Arts and/or supporting the guild or guild household at an event or Faire and b. Attended functions as a guest of the Diamond Rose Academie d'Armes and c. Completed a period of provisional membership as described in following sections. d. Is a student in good standing at the Diamond Rose Academie d'Armes. 2. Members will attend Renaissance Faires and other educational events while abiding by the rules of conduct of The Diamond Rose Academie d'Armes. 3. Good standing shall be maintained by a. Timely payment of all dues b. Attendance at 50% of the guild's annual functions or other activities as approved by the guild board c. Accordance to the rules of conduct 4. Provisional Membership: individuals who have expressed an interest in joining the guild may spend up to one year as provisional members. Such members must meet all of the requirements of good standing listed in section 3. Dues for provisional members shall be set so that they cover the cost of insurance. At the end of one year if they are still interested in becoming full members they may apply for full membership. A vote shall be held at the next regularly scheduled meeting, a simple majority shall rule. B. Guests 1. Guests are people who are not regular members and may include: a. Current members of other renaissance guilds b. Potential members c. Instructors 2. Guests must follow the rules of conduct 3. Guests will be expected to participate, assist and adopt period dress in accordance with guild guidelines to the best of their abilities. C. Instructors Instructors are special guests who are invited to attend an event or the purpose of providing instruction to the guild members as well as for demonstrations for both the guild members and the public. D. Rules of Conduct 1. Members shall be aware of the various risks associated within and without the classroom as well as within and without the guild site at all times during events. Attempts to minimize risks will be taken at all times. 2. There shall be no smoking within the perimeter of any guild event at any time. Members shall in addition observe the no smoking policy of any particular event site. 3. There shall be no alcoholic beverages consumed within the perimeter of any guild event during Faire hours. 4. All participants must abide by the ruling of the guild officers, master at armes and marshal. Complaints will be addressed after Faire hours. 5. Each member shall show respect for other members and their property. They shall not use other's equipment without permission. Said borrowed equipment shall be returned to its owner or the place from which it was borrowed. 6. No member shall intimidate, abuse or otherwise harass any other member. Such actions or behavior may be grounds for immediate and/or permanent expulsion from the guild. 7. Duties may be assigned by the site coordinator or master at armes at an event. Each person is expected to participate in guild activities, which may include but are not limited to: Coordinating any preparations for an event Set-up, Transporting gear/props Tear-down Skits, lessons, gigs, performances, demonstrations, "meet and greet" Perimeter duty Water and snack duty Cleaning up the encampment Food preparation and clean up Failure to perform these duties as assigned may be grounds for disciplinary action. 8. Inappropriate or abusive behavior in itself or while under the influence of drugs or alcohol may be grounds for immediate expulsion from a given event and/or removal from the guild after review by the guild board. 9. Those members who are participating in weapons play shall follow the rules of engagement as listed in Appendix A 10. Loaner equipment: a. An item loaned to a Diamond Rose Academie d'Armes guild member or guest shall be returned in as good condition as it was received. b. No Diamond Rose Academie d'Armes equipment shall be loaned without approval of the site coordinator and/or quartermaster. The borrower may be required to sign a receipt. 11. Diamond Rose Academie d'Armes members who are guests with other guilds will conduct themselves with honor and respect and follow these rules of conduct, the rules of engagement and all other safety regulations of the Diamond Rose Academie d'Armes in addition to any higher safety standards or rules of conduct of the host. 12. Failure to abide by these rules of conduct is grounds for disciplinary action up to and including expulsion from the guild. 13. A copy of these rules shall be on display in the encampment. E. Grievance Process Membership in the guild is a privilege and not a right. If a guild member violates the Guild's Rules of Conduct, that individual may be warned, suspended or removed from the Guild. 1. Complaint: a. A guildmember (referred to here as the "filer") brings a complaint of a specific rule violation by another guild member or guest referred to as (member under consideration or guest under consideration) before an officer of the guild. b. The guild officer records the complaint. The officer is responsible maintaining the privacy of the filer of the complaint. c. The officer will determine what aspects the filer wishes to remain anonymous and whether a warning will be an acceptable remedy for the complaint. d. The filer will not discuss the issue with other members of the guild. e. If necessary, the guild officer notified brings the complaint to the attention of the board within seven days. If the member under consideration is an officer, said officer will be excluded from all board functions related to the complaint. f. The board shall decide within seven days of learning of the complaint whether or not the complaint constitutes an incident worthy of disciplinary action. All members of the board must maintain confidentiality of the complaint. If the board determines that there is a legitimate cause for complaint, this process is completed. 2. Notification: a. The review board must inform the member under consideration of the complaint at least two weeks before the next regularly scheduled meeting. 3. Warning: a. If the filer agrees that a warning is a satisfactory remedy, the board may choose to present the member under consideration with a warning stating the corrective action necessary to avoid further disciplinary action up to and including expulsion from the Guild. b. The warning can be presented in any form, and two board members must attend its presentation in person, or the warning may be sent by certified mail. c. The warning document must include the following: i. The rule which the Filer alleges the member under consideration has violated and any specific actions that the member under consideration must take and any specific behaviors that the member under consideration must avoid. ii. The date on which the Guild Board will first review the member's compliance with the warning d. The warning document shall also include a statement indicating that signing it will not imply an admission of guilt on the part of the member under consideration of the rule violations listed in the warning, but instead constitutes an agreement to avoid these behaviors in the future. e. The member under consideration will indicate his/her intention to comply by signing the warning. The Review Board will monitor compliance for the time period indicated on the warning and within three days of the review date indicated on the warning, the Review Board must determine whether or not the member under consideration has complied with the warning. The board must choose among these three alternatives: i. The member under consideration has complied sufficiently with the warning. No further action is necessary. This process is completed. ii. The member under consideration has not complied with the warning. The Review Board will determine the appropriate corrective action, up to and including expulsion from the Guild. g. The Board must take immediate action to inform the member under consideration of its decision. 4. Expulsion: a. Before the next meeting of the Guild, the officers of the Board shall vote on whether or not to expel the member under consideration from the Guild. This vote shall take place by secret ballot. A vote to expel a member must pass by a 2/3 (two-thirds) majority. If the member is not removed from the Guild, this process is completed. b. The Board must take immediate action to inform the member that he or she has been expelled from the Guild. c. The expelled member is still responsible for any dues or debts owed to the guild, and must return immediately any Guild property in his or her possession. d. The Board shall announce the expulsion and the rule violation, which occasioned it at the next Guild meeting. e. A member who has been removed from the Guild may not reapply for Guild membership, nor attend Guild functions as a guest, for a period of one year after his or her removal from the Guild. 5. Suspension At a Guild event, the Master at Armes, Site Coordinator or Guild Officer or his/her designee may immediately suspend the membership of a guild member who is not following the Rules of Conduct. The Master at Armes is responsible for making an immediate complaint to the Board as described above. During this period, the suspended member is still responsible for dues or debts to the guild, but may not take part in any Guild activities or events. This suspension remains in force pending review by the Board 6. Vacancy in Office a. Should the suspended or expelled member be a Board member, their office shall be filled as described above. b. Should the suspended or expelled member be the Guildmaster, the Deputy Guildmaster shall assume the title and duties immediately. Article IV - Meetings A. Corporate meetings shall be held at least quarterly. These meetings may be held in association with other events, such as Renaissance Faires. All members are invited to attend such a meeting. B. The Annual Meeting shall be defined as the meeting at which elections are held. All Annual Reports must be presented at this meeting. C. Notice of a Guild meeting shall be in writing, via e-mail, to all members in good standing at the time of the meeting. This notice shall be a minimum of 7 days prior to the meeting date. D. The Secretary shall present a review of the prior quarter's events. Other members are invited to comment. E. The Treasurer shall present a review of the books at each meeting. F. Other business shall be conducted as necessary. G. Guildmembers may give proxies to any other member in good-standing. Notice of such a proxy shall be in writing. No member shall hold more than two proxies at the same time. Article V - Safety A. Goals The goal of The Diamond Rose Academie d'Armes is to insure that those who wish to practice the historical forms of European martial arts can do so in an honorable and reasonably realistic fashion that stresses honor and safety. It is not the intent of The Diamond Rose Academie d'Armes to recreate actual combat. (see "Rules of Engagement" Appendix A) B. Injury Injuries will occur, despite the best efforts to avoid them. Injuries are defined as any bodily harm beyond a simple bruise or sprain; for example, lacerations, broken bones, concussion would all be injuries. Injuries occurring at any The Diamond Rose Academie d'Armes event, whether or not associated with swordplay, shall be investigated as described below. C. Incident Report If an unusual incident occurs, whether or not an injury is associated with the incident, such incident will be investigated and noted in an incident report (Appendix C). This investigation shall be done by the Guildmaster or his/her designee. Such an investigation shall commence immediately upon identification of an incident, and a preliminary report shall be available within 24 hours. The investigation shall include analysis of contributing factors and ways to prevent similar incidents in the future. The Secretary shall maintain a master file of such incidents. Should a violation of the Rules of Conduct or the Rules of Engagement be involved, a guildmember may be sanctioned as mandated by the Grievance Process. Article VI - Costuming and Characterization A. Historical Era We have chosen to play Diamond Rose Academie d'Armes in the 15th, 16th centuries. We are an elite corps of townsmen and townswomen and the Academie d'Armes, we often travel through England to pay homage to the sovereign and to teach those associated with the Tudor Court. We provide Renaissance fencing demonstrations as well as many aspects of traditional, simple English life-styles. We portray the military for noble support and demonstrations, but have a large presence of trades people and peasants to support the encampment. B. Characterization Members within the Guild are not all fencers; various support roles as well as guest roles will exist. For example, a ship's captain could be training with us in trade for our passage to England. Since we do not travel with the Royals, we will be staying at a variety of inns, or within private homes or within our military encampment - our hosts will frequently be present in the encampment. C. Costuming 1. Costumes should represent the character you have chosen to play. For the most part, members of the Diamond Rose Academie d'Armes would be trades people, peasants who support the military Guard, middle-class or higher, although not royal. As such, some types of fabrics, colors, and styles will be more appropriate than others. 2. No member of this guild shall have a costume using fabric in neon colors, lamé or other metallic colors or purple. 3. Each member shall present a costume plan to the guild as a whole at a regularly scheduled meeting or at a regularly scheduled class or post-class meeting such as a sewing/acting sessions in which guild members are invited to attend. The plan shall be reviewed, and the officers of the board will grant approval. A senior member of the guild shall assist the member in putting a costume together, and verifying that the final costume has followed basic guild guidelines. Loaner costumes or parts of costumes may be loaned to members or provisional members who do not have access to an approved costume. Each costume may also include the implements that would be normally be associated with the character's trade, such as; a seamstress would have a needle case and material, a farmer would have farm tools, a weapon smith would have blade sharpeners or cleaners, a cook would have cooking tools. Deviation from the garb guidelines will require repeated guild approval prior to being worn at a guild event. The costume plan shall include intended fabrics, colors and finishing items. It will not include weapons or armor. 4. References can be quite difficult to obtain, but there is information on the Diamond Rose website. 5. BASIC EQUIPMENT LIST a. Basic costume 1. Shirt or Chemise (two are suggested) 2. Doublet or Bodice 3. Breeches or Skirts (two skirts are optimal) 4. Hose (two pair are suggested) 5. Boots or (sandals if playing a peasant, but not for bouting or sparring) 6. Hat or other period headgear 7. OPTIONAL: Jerkin or Gown (worn over the Doublet or Bodice) 8. OPTIONAL: Boots (more for fighting) 9. OPTIONAL: Cloak b. Mug or cup, bowl or plate and utensils (period and status appropriate) c. Personal weapons d. Sunscreen e. Water f. Prescription and other necessary medications g. Prescription eyewear D. Weapons Weapons may be considered a part of everyone's costume. Weapons used for fighting must meet Diamond Rose criteria. During Faire hours, guild members shall be considered to be going about their daily business in town according to their social standing or according to their character's trade. As townsmen and women, nearly everyone would have a belt knife. If carrying any other piece, it would most likely be a rapier, small sword or side sword. Long swords and daggers are seen less commonly. Weapons should be sheathed and/or peace-tied when not in the encampment. Appendix A Rules of Engagement 1. All fencers will bout with safety as their first priority. Participants will show respect and courtesy for other fencers, marshals, the master at arms and guests. 2. The use of foul language, or any display of rudeness will not be tolerated. 3. Intoxication or being under the influence of alcohol or drugs, prescription or otherwise is prohibited. 4. The marshal for the event will clearly define the boundaries. Participants will be made aware of features within the area that may be of risk. 5. Fencers will not be pressed into the bounds or across unsafe terrain. Fencers will not press their opponent into the boundaries or across unsafe terrain. 6. The marshal or other participants may call, "Beware of bounds." if any fencer nears touching a boundary or unsafe area. The marshal and the participants will keep the event area safe. 7. During the bout where arises a risk of harm to someone the marshal or participants will call "Hold." At any risk of injury to participants or bystander, any participant may call, "Hold." retreat from the engagement while on guard, then drop to one knee and lower the sword tip to the ground. Participants hearing the call of "hold", shall repeat the call of hold, and then follow as above. 8. Fencing contact will be made to the lightest touch, period. Lightest touch is that which your opponent will accept as a valid hit. Gauge if necessary. 9. Within the bounds fencers will wear proper and appropriate gear. Fencers will wear the required protection, which includes a three-weapon mask, gorget; gloves with a minimum of three-inch cuff, appropriate personal protection and all skin will be covered. 10.Fencing equipment will meet the specification of the Diamond Rose and pass inspection by a marshal. The marshal has the final say on standard and safety of equipment. 11. Fencers will strictly abide by commands and rules of engagement from any marshal. Participants will immediately bring any witness violations to the attention of the marshal. The marshal will determine the action of discipline for violation. Fencers and marshals will abide by commands and rules of engagement from the master at arms. 12. The master at arms will be acting marshal at all events, and will be respected as the senior marshal 13. No fencer will ever strike another fencer who is unaware of his or her presence. Do not attack if you are out of your opponents line if vision/sight. 14. You may only attack opponents who are reasonably able to defend themselves. 15. No fencer will ever strike out of anger, or with the intent of harming another fencer. 16. Fencers may not run or make any running attacks. There will be no fletching attacks. 17. Fencers will play to the three wounds, which is the same as unable to continue the bout. 18. To lose both hands or both arms is considered disarmed and has the same result as unable to continue the bout. Appendix B Character Guidelines Things you should consider when deciding on a character or persona to portray. 1. What kind of character will I be comfortable with? Each class has it's own rules of behavior that should be adhered to. 2. How much time do I want or have to spend on researching an historical character? 3. How much money do I want to spend? Peasants are inexpensive and soldiers are not much more. 4. Do I want a costume that I can throw in the washing machine? Most faires and events are hot and dusty. 5. Do I have the time and money or weapons and armor? 6. Do I have the special talents for this character? Singing, dancing, playing an instrument, etc. Not advised: 1. Pirates or made-up fictional or fantasy characters 2. Characters outside of our time period; roughly 1551 - 1600 Europe 3. Royalty or close associates or well-known, famous persons 4. Characters of non-European origin There are some excellent resources and reference materials available on the Diamond Rose website to help you work on a character. Are they married? Do they have children? Where are they from? How did they get involved in this group? Talk over possible characters with other people in the group. You can get some good ideas this way. The fighters are the Academie. The non-fighters are the household. Depending on what type of character you eventually decide on, you'll be part of one of two branches of the guild. There are in fact two groups within the guild, Academie and Household. There are no real practical differences between the two for membership. Faire Etiquette This document is intended to serve as a guide for members and their guests. This will let everyone know what is expected of him or her in terms of behavior. Everyone will be expected to follow the rules of conduct above. Violations of these rules will call for a reprimand. 1. The single most important thing to remember is that we are guests at these events. People come to these to be entertained by the spectacle of costumed actors, "us", whether we portray the King's Guards, of just a fencing school for the weekend. It's therefore important that we remain "in character" at all times when in public view. Talking about baseball, computers, drinking from modern containers will ruin the illusion we are trying to create. 2. Guild members are expected to be present and on time for any processions or appearances that may be scheduled for the day. If there is some kind of problem, please let an officer know right away so that we can make other arrangements if needed. This does not mean that you're expected to be working every moment of every day. If you are not needed you are free to enjoy that faire or take a nap if needed. Please be sure to check out with someone of authority first so we'll have an idea where you'll be and when we can expect you back should you be needed. 3. When doing street appearances or just interacting with the guests, keep a few simple rules in mind; a. Never touch a guest unless you are certain that they will not take offense. A lot of people do not like to have their personal space invaded, especially women. If you have any doubts, Don't. b. If you "get stuck" and feel like you are going to break character, it's fairly easy to make up an excuse to leave, "Bon Dieu, I'm late for a duel!" You are not expected to be a professional the first time out. c. If a patron doesn't want to play, respect their position. A lot of people get a big kick out of interacting with us, but there are some who just want to watch, be respectful and be willing to take no for an answer. Always be honorable, courteous and chivalrous. 4. Dealing with rude customers; if there is any kind of problem with a guest, try to be as polite and diplomatic as possible in handling it. If you run across anyone who is drunk, and yes it can happen, or just unhappy about something, refer the problem to an officer of the academy or call faire security, Walk away if possible. Do not say or do something that will make the situation worse. 5. When we are running a tourney or giving lessons in the guild area, it is expected that All members will be helping out. At some events, 10% of the people do 90% of the work. All members are expected to be on hand. Heralding in the street, running around, running the tournament lists, answering patron's questions, and so forth. During your free time you can enjoy a walk around or just pull up a bail of hay and enjoy watching. 6. Most events have what is referred to as quiet time. In the camp areas as a general rule it's 10pm to 6am.
